TalknGift Privacy Policy

This Privacy Policy explains how TalknGift ("TalknGift," "we," "us," or "our") collects, uses, shares and protects information when you use our website at talkngift.ai and talkngift.com and our text-message group gifting service (together, the "Service"). By using the Service, you agree to this Privacy Policy.
The short version: We use your phone number and the messages you send us only to run the group gifts you take part in. We never sell your information, and we never share your mobile number or text-messaging opt-in data with third parties or affiliates for their marketing or promotional purposes.
1. Information we collect
Information you give us
- Mobile phone number, when you enter it on our website or text our number.
- Text-message consent records: which message types you agreed to, the date and time, the page or keyword you used, and the consent language shown to you.
- Gift contributions you send by text, such as messages, photos, voice memos and videos, plus details you provide about them (for example, the year a photo was taken).
- Gift details from organizers, such as the recipient's first name, the occasion, the date, and the payment handle where contributions should be sent (for example, a Venmo username, PayPal.Me name or Zelle email or phone number).
- Pledges, such as the amount and payment method a contributor says they sent.
- Support messages you send to us by text or email.
Information collected automatically
- Basic technical data when you visit our website, such as IP address, browser type, pages visited and the time of your visit, which our hosting provider logs for security and performance.
- Message delivery data from our text-messaging provider, such as whether a message was delivered.
Information we do not collect
We do not ask for or store credit card numbers, debit card numbers or bank account numbers. Contributions are sent directly from contributors to the organizer through Venmo, PayPal or Zelle; TalknGift does not receive, hold or transmit money.
2. How we use information
- To provide the Service: set up gifts, send the text messages you requested, collect and organize contributions, track pledges, and create and deliver the finished gift.
- To send optional TalknGift news and offers by text, only if you separately opted in to those messages.
- To respond to HELP requests and support questions.
- To honor opt-outs (STOP) and keep records of consent and opt-out as required by law and carrier rules.
- To keep the Service secure, prevent fraud and abuse, and fix problems.
- To comply with legal obligations.
We may use automated tools, including AI services operating on our behalf, to transcribe voice memos, organize contributions and draft gift content. These providers process your content only to perform services for TalknGift.
3. SMS / text messaging privacy
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as customer service and message delivery, is permitted. All other categories of sharing described in this policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
- We send text messages only to people who have opted in, either by submitting our web form with consent or by texting our number first (for example, by sending a JOIN keyword from a gift invite).
- Reply STOP at any time to opt out. We will send one message confirming your opt-out and then stop texting you. Reply HELP for help.
- Message frequency varies. Message and data rates may apply.

4. How we share information
We do not sell or rent your personal information. We share information only as follows:
- With other participants in a gift you join. Your contributions (and your name if you provide it) are shared with the gift organizer and included in the finished gift for the recipient. Organizers can see who has contributed and pledged. Your phone number is not shown to other contributors or to the recipient.
- With service providers who help us operate the Service under confidentiality obligations, such as our text-messaging provider, website hosting and cloud storage providers, transcription and AI processing providers, and printing partners (only when a printed gift is ordered). They may use your information only to provide services to us.
- For legal reasons, if required by law, subpoena or court order, or to protect the rights, safety or property of TalknGift, our users or others.
- In a business transfer, such as a merger or sale of assets, subject to this policy's protections, including the SMS commitments in Section 3.
5. Data retention
- Raw photos, voice memos and videos are deleted within 90 days after a gift is delivered. The finished gift is kept for as long as the organizer keeps the gift active.
- Consent and opt-out records are kept for as long as required to demonstrate compliance with applicable law and carrier rules (generally at least four years).
- Any contributor can text DELETE MY STUFF or email us to have their contributions removed from a gift.
6. Security
We use reasonable administrative, technical and physical safeguards to protect information, including encrypted connections (HTTPS), private storage, and short-lived links for gift media. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
7. Your choices and rights
- Text messages: Reply STOP to opt out of any or all messages. Opting out of news and offers does not stop messages for a gift you are actively part of unless you reply STOP.
- Access, correction and deletion: Email support@talkngift.ai to request a copy of your information, correct it, or delete it. We will respond within the time required by applicable law.
- State privacy rights: Depending on where you live, you may have additional rights under state law (for example, California, Colorado, Connecticut, Virginia and others). We do not sell personal information or use it for targeted advertising. You will not be discriminated against for exercising your rights.
8. Children's privacy
The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us information, contact us and we will delete it.
9. Changes to this policy
We may update this Privacy Policy from time to time. We will post the updated version on this page with a new effective date, and if changes are material we will provide additional notice where appropriate.
