TalknGift Terms of Service

These Terms of Service ("Terms") govern your use of the TalknGift website at talkngift.ai and talkngift.com and the TalknGift text-message group gifting service (together, the "Service"), operated by TalknGift ("TalknGift," "we," "us," or "our"). By using the Service, including by submitting our sign-up form or texting our number, you agree to these Terms and to our Privacy Policy.

1. The Service

TalknGift helps people create group gifts over ordinary text messages. An organizer starts a gift, invites friends and family with a link, and each contributor sends photos, voice memos, messages and pledges in their own private text thread with TalknGift. TalknGift organizes the contributions and produces a finished gift, such as a web page, audio montage or printed book.

2. Eligibility

You must be at least 18 years old to organize a gift. Contributors must be at least 13 years old, and contributors under 18 must have permission from a parent or guardian. You must be the subscriber or authorized user of the mobile number you use with the Service.

3. SMS Program Terms

• Program name: TalknGift.
• Program description: Text messages to set up and run group gifts you organize or join, including setup questions, contributor prompts, progress updates, reminders, pledge confirmations and links to the finished gift. If you separately opt in, you may also receive occasional TalknGift news and offers.
• How you opt in: by entering your mobile number and checking the consent box on our website, or by texting our number first (for example, by sending a JOIN keyword from a gift invite).
• Message frequency: Message frequency varies. Gift messages are typically up to 10 messages per week while a gift you are part of is active. News and offers, if you opt in, are up to 4 messages per month.
• Costs: Message and data rates may apply. Check your mobile plan for details.
• Opt out: Reply STOP to any message to stop receiving texts. You may also reply STOP ALL, UNSUBSCRIBE, CANCEL, END or QUIT. You will receive one final message confirming your opt-out. To opt back in, reply START.
• Help: Reply HELP for help, or email support@talkngift.ai.
• Carriers: Supported on major US carriers. Carriers are not liable for delayed or undelivered messages.
• Consent is not required to buy: Consent to receive text messages is not a condition of any purchase.
• Privacy: We do not share your mobile number or opt-in data with third parties or affiliates for their marketing or promotional purposes. See our Privacy Policy.

4. Organizer responsibilities

• Only share gift invite links with people you reasonably believe would want to take part. Each person chooses whether to text TalknGift.
• Do not give TalknGift anyone else's phone number for us to text, including the gift recipient's. TalknGift prepares messages for you to forward from your own phone instead.
• Provide accurate payment details for receiving contributions, and use only payment accounts that belong to you.

5. Money and payments

TalknGift does not collect, hold or transmit money for gifts. Contributors send money directly to the organizer using third-party services such as Venmo, PayPal or Zelle, under those services' own terms. TalknGift only shares the organizer's payment link or details and records pledges. We are not responsible for payments made through third-party services, including payments sent to the wrong account, reversed or not received. If TalknGift offers paid products (such as a printed book), the price and terms will be shown before you buy.

6. Your content

You keep ownership of the photos, voice memos, messages and other content you send ("Your Content"). You give TalknGift a limited, non-exclusive, royalty-free license to store, copy, edit, transcribe, arrange and display Your Content only to operate the Service and create and deliver the gifts you take part in. You confirm you have the right to share Your Content and that it does not violate anyone's rights. You can ask us to remove your contributions by texting DELETE MY STUFF or emailing us.

7. Acceptable use

You agree not to use the Service to send content that is unlawful, harassing, hateful, sexually explicit, or that infringes others' rights; to spam or text people who have not agreed to take part; to impersonate others; or to interfere with or attempt to gain unauthorized access to the Service. We may suspend or end access for anyone who violates these Terms.

8. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, TalknGift disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that messages will be delivered, that the Service will be uninterrupted or error-free, or that a gift will be completed by a particular date.

9. Limitation of liability

To the fullest extent permitted by law, TalknGift will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, money or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid TalknGift in the 12 months before the claim or US $50.

10. Changes and termination

We may update these Terms from time to time and will post the updated version on this page with a new effective date. Continued use of the Service after changes take effect means you accept the updated Terms. You may stop using the Service at any time by replying STOP. We may suspend or discontinue the Service at any time.

11. Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law rules.
